Judicial Tyranny

The number of lawsuits filed by the left trying to stop the Trump administration is approaching 50. We’ve seen this before. It’s the exact same “lawfare” strategy the left deployed in 2017.

 

We already have some beyond outrageous opinions that simply cannot stand. I want to zero in on just one that is the most obnoxious. New York federal Judge Paul Engelmayer, an Obama appointee, issued an order blocking Elon Musk and his DOGE assistants from accessing any Treasury Department data.

 

What President Trump is doing with the DOGE team is auditing the federal government to find out what it is doing with your money. Businesses and non-profit organizations all across America go through real audits every year. But not our federal government.

 

But now that a real audit is being done, outrageous and depressing things are being discovered, and the left is going nuts because this corruption and waste are being exposed.

 

Evidently some judges should have studied civics more carefully. All of these federal agencies are part of the executive branch of government. The head of the executive branch is the president.

 

The president nominates political appointees to lead these agencies. They, in consultation with the White House, hire other political appointees to go into each of these agencies.

 

These political appointees don’t go to be told by career bureaucrats what they are supposed to do. These presidential appointees and their deputies go to tell the career bureaucrats what they are supposed to do.

 

Judge Engelmayer turned that basic description of the executive branch of government upside down. He not only ruled that DOGE cannot look at the Treasury Department’s records, but he also banned the Treasury secretary himself from looking at his department’s records. Only the career bureaucrats are allowed to access the records.

 

This now gets into really serious territory. It is well established that an unconstitutional law, in fact, is not actually a law. Some will retort, “The courts decide what is constitutional.”

 

Actually, all three branches of government take an oath to follow the Constitution. What this federal judge has ruled is clearly unconstitutional. He cannot order the executive branch of government to not conduct financial audits of the agencies it oversees.

 

The White House, of course, is appealing the order. But, in my view, the president should simply say, “This order is unconstitutional on its face. I took an oath to uphold the Constitution. I have a moral, ethical responsibility to make sure the taxpayers’ money is not being wasted, and I will not allow a Democrat hack masquerading as a judge to deter me.”
