The Babylon Bee Challenges California Censorship

The Babylon Bee is challenging two California laws that censor political satire and force large online platforms to become state snitches. Learn more: https://adflegal.org/article/humor-trial-babylon-bee-challenges-california-laws-censoring-political-satire/ The first law, AB 2839, applies around election time to any person or group who distributes “materially deceptive content” about candidates, elected officials, and other election material. It also requires people to put disclaimers on many satirical posts, which would defeat the point of satire. The second law, AB 2655, requires large online platforms to sometimes label and other times take down posts with “materially deceptive content” about elections. It is set to go into effect on Jan. 1, 2025. Alliance Defending Freedom challenged the laws on behalf of The Babylon Bee and Kelly Chang Rickert, a Los Angeles attorney who regularly expresses her political beliefs publicly online. And after the district court ruled that AB 2839 likely violates the First Amendment, California officials agreed they cannot enforce the law against ADF’s clients.
